Fraudulent Foreclosure and the Danny Hammond MIKE SINGLETARY Offense For Borrowers Facing Fraudulent Foreclosure

The theory behind my "Mike Singletary Mortgage Fraud Offense" begins with the premise that in your foreclosure court there are some nameless players who aren't really affecting the game as much as you think.

These players include the Imposter and Fictitious Payee Foreclosing party who is pushing a baseless claim and its attorneys who are the puppets voicing this claim. But, there is one party in your court who is keeping you from winning.

It is no secret that I think it is your judge and I am almost always right.  So, to explain my strategy let's pretend that your court is a football game. You are in the right which puts you down on your opponent's 30-yard line with the ball and one minute left to score a touchdown and win the game.   Your foreclosure judge is the embodiment of Mike Singletary. For the 8 people in America who are not children, but still haven't heard of Mike Singletary, he was the phenomenal middle linebacker who was drafted by the Chicago Bears in the 2nd round of the 1981 NFL Draft and became to be known as probably the greatest linebacker of all time as "The Heart of the Defense" for the Chicago Bears' Monsters of the Midway in the mid-1980s.

So, in my little metaphor, Mike Singletary represents your judge and he has been knocking down passes, sacking you, the quarterback, stuffing all the running plays and pretty much controlling the game. He is offsides on every play.  He is holding lineman, interfering with pass receivers, roughing the quarterback and generally is operating with complete disregard for the rules.  There is no accountability for his actions.  No one will argue with him.  He is accountable to no one.  There are no consequences for his actions.

You are not going to win if Mike Singletary continues to play.

Therefore, Mike Singletary must be removed from play, no matter what it takes. So, you call a timeout and on the next play, you send 15 players on the field and hike the ball to the quarterback who takes a knee while the other 14 players pile on Mike and twist his ankles, bite his ears, and break his arm.

This is, of course, against the rules so you accept your penalty for "too many men on the field " and huddle up. Three plays later you score. You win because you neutralized the one person who is intent on beating you on this day and he could have without your brutal and decisive action.

THEY'RE GONNA PARTY LIKE IT'S 1999! DANNY HAMMOND FORECLOSURE FRAUD PRIMER 101 - JUST WHAT DID CAUSE THE WALL STREET MELTDOWN OF 2008

(Mortgage Meltdown Is The Wrong Terminology)

These words below do not come from current events.  They aren't the only quotes from famous writer. They all have something to do with my thinking, as I have tried to do the right thing for all Borrowers who were cheated from obtaining the American Dream.

For those of you who have followed the news for the last several weeks, did you notice that four medium banks had failed suddenly?

The word "medium" is what I would like to point out first.  These were medium banks by todays measure.  Before 1999 they would have been mega banks.  But, the last of these four recent banks to fail and be snatched up by the one time failures of Wall was purchased by JpMorgan Chase Bank a bank that is mega by today's standards.  JpMorgan Bank, Bank of America, Citi, Wells Fargo

In September 2008, Congress approved the “Bailout Bill,” which provided $700 billion to add emergency liquidity to the markets. Through the Troubled Asset Relief Program (TARP) passed in October 2008, the U.S. Treasury added billions more to stabilize financial markets - including buying equity in banks.

Now, if you don't know this you should.  That when you read the government used money to prop up the same broke banks that stole our houses that the government they were talking about was our government.  In other words, you as a taxpayer and all of your taxpayer compadres took this burden on our consolidated taxpayer backs.

The Federal Reserve began buying the same mortgage-backed securities that myself
and everyone I know that thinks about this stuff looked for many years years to find any mortgage-backed securities and found none.  The Federal Reserve which is not part of the US Government it is an association of US Banks has been buying $40 Billion of mortgage- backed securities every month by printing the money (which is very, very inflationary) which is again on the backs of the US taxpayers.  (If you are a taxpayer this includes you)

What caused all this ruckus?  Well our government in 1934 was nothing like the lunatic asylum that it is today.   Smart men with no television no mega yachts, and believed in facts and truth studied what caused the 1929 Wall Street Crash and the ensuing Great Depression.  The law that they came up with was called the Glass-Steagall Finance Act of 1934.

Any one can understand the two most important parts of it that kept our country's economy safe for nearly 70 years.  In 1999 the democrat president and a Republican thought it would be best if they repealed Glass-Steagall in full without putting back any laws in its place.  8 years later all of our lives were destroyed and we were left with nothing except the pleasure of paying all of the broke mega banks money to make them rich again.

NOT SINCE 1999

I don't think that hardly any American citizens are aware that the Democrat president Bill Clinton and a Republican Congress repealed a 66-year-old banking and finance act known as the Glass Steagall Banking Act of 1933.  This Act put together all of the research of the 1929 Wall Street Meltdown that sparked the great depression and wrote an act to prohibit ever happening again.  The Act did its job.  For 66 years there was no such event in the US.  The Act was repealed in full as an act of Deregulation of the banking and finance industry.  The president and the congress that repealed all relevant regulation of banking in 1999 put nothing back in its place.  Seven short years later Wall Street imploded triggering the Wall Street Meltdown of 2007-2008-2009 through today.  Frank Dodd was supposed to replace it, but both sides of congress had gutted it into a meaningless corpse by the time it was enacted.

There has been no meaningful regulation of finance since 1999, over twenty years.  If there are no regulations there is no need for regulators.  The only meaningful regulation coming out of Frank-Dodd was provided by the Consumer Finance Protection Bureau.  Donald Trump sent his evil little henchman Mick Mulvaney to render it useless in 2017.  It took him 3 days to send 100 million dollars in collected fines back to the banks that paid had voluntarily paid them.

Acting Director of the Consumer Financial Protection Bureau

The CFPB has been around but has done nothing relevant since December of 2018.  If you have been wondering why the CFPB does not answer your pleadings for help, it is because there is no one there to read them.  This is what the word deregulation means in America in the 21st century.

The taxpayers propped up the "Too Big To Fail Banks" with 3 trillion dollars.  The revived banks have been on a relentless crime spree ever since.  Responsible for tens of millions of fraudulent foreclosures based on servicing lists and not Promissory Notes.

In the headline in the story below from Wall Street On Parade, the beginning of the headline says"Using Bank Deposits".  By this, they mean JPMorgan Chase used the money from the depositors checking and savings accounts to fund "risky investments".  Glass-Steagall does did not allow this.  However, there is no prohibition from doing this in NO regulation.  Nothing is prohibited.  This has not been fixed for twenty years.  Wake up depositors, JPMorgan Chase was using taxpayer insured (FDIC) checking and savings deposits to fund its risky investments.  These particular risky investments were in fact so risky they failed to the tune of 3.2 Billion bucks.  The taxpayers will just have to pay even more taxes to cover it.  Jamie Dimon is no better than a modern-day Al Capone.  CONTINUE READING

CREDIT BID; DISTRIBUTION OF THE HOME SALE PROCEEDS: THE BIGGEST FRAUD IN FORECLOSURE FRAUD IS THE FRAUDULENT FORECLOSURE SALE!  WHY IS IT ONLY BOTHERING ME?

It ain't what you don't know that get's you into trouble, it's what you know for sure that just ain't so!"         -Mark Twain

by Danny Hammond of the 3/4 court press

Let's just go through some real quick statistics here.  In 1994 there were just 48 non-judicial foreclosures for the ENTIRE YEAR in Jackson County, Missouri (a large part of Kansas City, MO proper) It is probably about as average as a county can be.  It contains areas of urban, suburban, rural, and forest.  It is a good place for me to vet my own strategies.  But, every county, city, or town in America will most certainly have the same ratios of wrongful foreclosures which are easy to spot in every county recorder's office.

By 2001 there were 1,700.  By 2006 there were 7,200 Non-Judicial Foreclosures for Jackson County, Missouri.

For the last four years, there has been an average of 300 Non-Judicial Foreclosures per month or an average of 3,600 Non-Judicial Foreclosures per year for the last eight years.

That is 14,400 families displaced in one average county over four years and each and every one of these Non-Judicial Foreclosures was so fraudulent that it makes my eyes burn just to type this.

All of our country's courts are limited to having jurisdiction over disputes described as cases and controversies That means that two parties are arguing over their interests in the same subject matter.

In every foreclosure sale, I have ever read or heard about, the foreclosing party claims to have paid some amount of money for your home at a sale conducted by themselves and, in non-judicial foreclosure states, their personally substituted Trustee.  (26 states have these unconstitutional sales)

Folks, It is a load of crap. They all are letting everyone believe it was a sure-fire honest deal. No, it wasn't. There is no way they had the legally obtained Promissory Note, or if it was Fannie Mae or JPMorgan or some other member of that ilk, there were probably two or three different versions of copies of your one and only Promissory Note filed into your court.

The judge can't help either party, but they do have to protect their own court.  The United States Constitution makes it the COURT's responsibility to see that the foreclosing party can prove it was even injured.  Injured means that they really LOST some money on your deal.

The courts are not doing this.  The judges not seeing this lack of Standing are either crooked, biased, or stupid.  Maybe all three.  But, it is their own hide that they should be protecting.

WHO HAS STOLEN THE TRUCKERS MONEY? WE HAVEN'T HEARD MUCH HAVE WE. I BET YOU THOUGHT THE MORTGAGE MELTDOWN WAS OVER. NOT SO FAST. THOUSANDS OF RETIREMENT PENSION FUNDS LOST TRILLIONS OF DOLLARS BUYING THOSE MORTGAGE BACKED SECURITIES.

WHO DID YOU THINK THE WALL STREET STOCKBROKERS WERE SELLING THE CRIMINALLY FLAWED MORTGAGE-BACKED SECURITIES TO?

COULD YOUR PENSION HAVE BEEN AFFECTED?  MANY HAVE BEEN.

Reposted from April 2016- because it is all coming back around.  You should be making plans.  My wife mentioned four years ago that she could see a revolution on the horizon once everyone understood how many people had been fraudulently thrown from their homes by their own American government and courts.

I have written about the investors in the Mortgage-Backed Security bonds which included many, many pension funds three years ago.  One hard-hit investor was the Boston Police pension fund, but they didn't know it yet.  I wondered to many people who would be dumb enough to defraud the retirement of every Boston policeman?
Who knows better how to get even?  My personal guess is nobody.  READ MORE

MORTGAGE FRAUD-THE SACKING OF ROME IN 410 AD-THE GLASS STEAGALL ACT OF 1933 AND THE REASON FOR THE USE OF FIREWALLS

"When they call the roll in the Senate, the Senators do not know whether to answer 'Present' or 'Not guilty.”        Theodore Roosevelt

Reposted because I have always liked it and not enough people have read it.

by Danny Hammond
FIREWALLS:  This word is broadly defined. But, I think we can all agree that it is a device or strategy placed within a system to back up the day to day rules and regulations are attacked from outside or within the system and this attack bypasses the system to cause damage to that system.
I just read that and yes, it will work for the purpose of this article.

Although the date of the founding of Rome is steeped in legend and mystery, as well as some historical writings, it is generally considered to be April 21, 753 BC. Since it is a story of at least one thousand two hundred years and it has to do with brothers named Romulus and Remus and something about their mother being a She-Wolf,  for the duration of this article we will just use the above date. All agreed?  Yes.

My only reason for referencing Rome is that throughout all of its in-fighting, treachery, betrayal, greatness, open government, etc., Rome survived so long because there were always in place some "must always be so" rules.

We ended up yesterday with the smart guys of 1933 putting together a new set of financial regulations to replace the old deregulated financial regulations (Which I call the no rules and no referees rule) that had replaced some good regulations.  Yes, they all could sleep soundly now that the "Scoundrels of Wall Street" were playing the game with the new regulations (rules) which were being watched by new regulators (referees).

In fact, the simple but strict Glass Steagall Act of 1933 kept four generations of American families safe.  There were blowups along the way, but nothing like the financial firestorm of the 1929 Stock Market conflagration. For 66 years this Act stood steady as a rock.  The Act was always under attack by the believers in what we call "Supply-Side Economics" which the true believers (financiers and stockbrokers and rich people) explained over and over that would help all Americans have plenty of money.  Supply-Side Economics means that if you don't tax the rich they will have more money and if they have more money the rich will spend it on stuff.

Since this stuff was made and sold by just plain old folks, then these plain old folks would make more money off of the taxes that weren't collected from the rich, than they would have made if they had gotten the tax breaks themselves.  Does this sound familiar? and profoundly stupid?

That is because it is stupid, (The United States has debunked this faux-economic theory FOUR TIMES or more including 1999) but many economists (rich economists that wanted tax breaks I bet) kept hammering and hammering away with these economic theories.

The Good Ol' Glass-Steagall Act of 1933 just sat there watching the players and the regulators (referees) using the regulations (rules). Everything was working rather well.  (Oh No!)

“You can accomplish more with a smile, a handshake, and a gun than you do with just a smile and a handshake.   I’m a kind person, I’m kind to everyone, but if you are unkind to me, then kindness is not what you’ll remember me for.

Capitalism is the legitimate racket of the ruling class.   A crook is a crook, and there's something healthy about his frankness in the matter.  But any guy who pretends he is enforcing the law and steals on his authority is a swell snake. The worst type of these punks is the big politician."

Quotes from Al Capone (spun together into a light narrative by Danny Hammond)

by Danny Hammond

It's funny, I think about but I don't talk about the deregulation of banking being the hottest trigger of the three top reasons that you and I lost our homes.  I wasn't behind on my payments at the time of my Missouri style non-judicial foreclosure and I can guess what happened to the caller within 3 minutes of when I get a call from someone who was done wrong and contacted me from this website.  I have heard from hundreds, but each of them was facing it for the first time.

The reason that I say it is funny because the reason that I don't talk about deregulation much is that no one much wants to hear about it.  However, I think it is the most wicked and flagrant method anyone could dream up for attaining the illegal theft of a house.

Non-judicial foreclosure has been ruled in 26 states to be constitutional, but judges decided this.  Thus began the problem of granting Imposters and Fictitious Payees that we mistakenly call banks the easily abused tool of enriching themselves and those they employee by using your money from your bank account to engage in risky lending and ventures that make them rich if they bet right and make you poor if they bet wrong.

In fact, after the historic Wall Street collapse of 1929, some really smart guys got together (I know who most of them were, but I'm going to leave them out of this short narrative because I cannot spell or pronounce all of the names) and they worked very hard to figure out what went wrong and they did find out what went wrong.  What they found out, coincidently is exactly the same things that created the later crash of 2007 thru, well now.      READ MORE
