I have read, and I still read, many messages from Borrowers
who are looking for help against mortgage fraud and wrongful foreclosure involving their homes.  Lately, I have run into
several Facebook Groups that exist for their members to collaborate and share their own searches on the internet and strategies that they have heard about or read about.  There are some issues with this that are causing them to  get overwhelmed and stuck.  

I know a lot about this.  Not because I am so smart, but because I am familiar with being overwhelmed and stuck.

It was easier for me to overcome because I learned about the Chain of Title of records recorded against the property that houses sit on starting at 12 years old with my Dad.  Most people never really deal with it more than once or twice in their lives.

Everything in life has a straight line.  A beginning and the middle and the end.  They never change positions.  In real estate, the straight line is usually more obvious than say a drive across the country.

I am as frustrated right now as I have ever been during the 12 years that I have been fighting
mortgage fraud.  In the movie "The Big Short" towards the end one of the Wall Street characters
is frustrated that a group of them has figured out how massive the fraud in mortgages has been. 

They even know who the worst perpetrators are beginning with Fannie Mae and working down through Citi Mortgage and the rest.  They have gone to all the big newspapers to blow the whistle just knowing in their minds and hearts that this is a near apocalypse and the biggest story in history.  Not one newspaper editor or reporter will give them the time of day.

1.  Because a fraud this large was too big to believe and 

2.  The newspapers' biggest stock owners were the same criminals running the fraud.

As they are walking back toward their office one of them muses, "I was afraid we were going to ceate panic in the streets.  I was sure that once people knew that their retirement plans had been ransacked by their own government and banking industry that we would have an actual revolution, an uprising by all Americans.  But look at them walking on along the street completely unaware and without enough background information to even get an inkling of what's going on.  And it's not their fault, they shouldn't have to worry about their lives being destroyed from within."

That's how I feel.  There are a scattered few around the country screaming their lungs out in warning, but the message isn't getting through.

I need to let one of the dupe perpetrators explain it to you himself.  What could be more powerful?

I have reviewed hundreds, possibly thousands of home loan paperwork preceding a fraudulent foreclosure.   I have read about many more.  I have never seen any deal where the foreclosing party was not relying on an assignment of the security instrument.  

IN THE 26 STATES THAT USE NON-JUDICIAL FORECLOSURE THE  MORTGAGE IS CALLED A DEED OF TRUST.  THE WORD MORTGAGE IS RARELY SPOKEN IN THESE STATES.

In Judicial foreclosure states, the assignment of the security instrument involves what is called a mortgage.  A mortgage is not a home loan.  It is merely the rule book concerning the collateral you put up to ensure that the bank will be paid back.  


A mortgage has no value and the assignment of a mortgage does NOT transfer your home loan from one party to another.  In the Non-Judicial States, the security instrument is called a Deed of Trust which serves the same purpose as a mortgage.  There is no such thing as "the assignment of a mortgage or a deed of trust.  The mortgage or deed of trust exists only as part of the loan agreement and it is incidental.  The security instrument is known as the incidental instrument (there are no laws that require collateral for a loan at all.)  


Your house is the usual collateral involving a home loan because that is where the loan money was spent.  But, collateral could also consist of one thousand Schwinn bicycles in a warehouse.  It is my strong personal belief that all (ALL) of the foreclosures in the United States from about the year 2000, or earlier, are based on the exact (EXACT) same lie.  What is that lie?

All of the Borrowers who come to me for advice on how to handle their mortgage foreclosure problems portray one distinct trait in common.  None of them understand the problem. They don't know why it seems so complicated. They know that there is something wrong with the system, but are completely unable to see what it is.  Why?

Because all of their lives they were led to believe that while some corruption did exist in America, you could still depend on the law and the financial system to treat you fairly because of the law and the trustworthiness (if that isn't a word, we will use it anyway) of generally our country.  We all have believed that America was the greatest country in the world.  That we were the good guys and that Americans, in the end, will do the right thing.  Not True.

There are 12 of us working loosely as a group and making our way through court each representing ourselves.  Is it wrong? Are we going to lose?  I have felt both confident and anxious over the last three years.  But, we have won four cases very recently, so the answer is that, yes it is possible.

I have been sitting in court and heard every judge admonish each of the members of my group that they "need to get an attorney"
. It is, on a general level, good advice.  But, these judges are missing some details that reduce that advice down to not really advice so much as an ignorant lack of reality.

I just got an email from a reader who was asking me once again, to tell him the best way to prove that a foreclosing party was not a "party in interest".  I am working on turning in a federal lawsuit against a federal lawsuit next week.  I have answered this question a thousand times (gross exaggeration).  The answer is always the same.  A borrower never has the burden of proof.  It is the foreclosing party and the judge of the court that have that burden.  Borrowers don't try to find your Promissory Note, it is the foreclosing party that does not have that note.  Why would you help them?  Make the court run the case as was directed in Article III of the constitution. That answer can be found in multiple places in this blog.  But, I had a different answer to the problem.  Read it below.

Richard, I have been preaching the same thing for a year and a half.  The laws cannot vary from state to state. The vast majority of judges are not even aware of the laws that remove their immunity due to actions of their own.

#1  Ms. Kendra J. Stockdale Associate Circuit Court (Sewer Court) Judge from The 16th Circuit State Court of MO.  She committed the flagrant violations of "Lack of Standing for the Plaintiff and therefore Lack of Subject Matter for her Court  While she was ruling against ME!

She achieved number 1 not because she committed the same crimes as the others but because she is the most arrogant little toady of any of the judges below.  She is first even though she is the last one that showed how much contempt she has for the same American Constitution that she swore an oath to protect and defend.  Her contempt for the same Americans who pay her salary (which she has not been earning.  Ms. Stockdale will go to the federal court.  (Keep those memberships rolling in)

#2  Ms. Mary Elizabeth Phillips Chief Justice of the Federal United States District Court of the Western District of Missouri.  Nominated by Obama in 2011 and named chief justice in 2019.  She has my house case.  Soon I want to quote her on this Blog for all of the stupendous drivel that oozed out of her when making Orders and Rulings.  For most of six years, I thought she was handicapped and could not learn.  But, in 2019 her orders became manic and unintelligible.  I first suspected, then I knew that she was the very first judge that I had more than suspected of being on the take.

All of my clients reference the probability that their judges take bribes.  I held out for seven years.  I believed, well I guess, I wanted to believe that it would be the courts that would save the day.  Nope. Again another nope.   CONTINUE READING

I was winning in federal court against GMAC Mortgage, LLC. It has now been a seven-year battle and I started way behind the learning curve, but I was catching up fast.  I am doing it Pro Se and this is going to sound crazy, but at this point, I don't think this game is for some average attorney.  This has never happened before.  This bankruptcy is designed to shut down hundreds of lawsuits against the Debtors ResCap and all their friends.
